DMCA Policy

1. Introduction
VibeKeys respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.
2. Notification of Claimed Infringement
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Site, please notify our copyright agent as set forth below. For your complaint to be valid under the DMCA, you must provide the following information in writing:
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
- Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on our Site (such as the URL).
- Contact Information: Your contact information, including your address, telephone number, and email address.
- Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
3. Designated Copyright Agent

4. Counter-Notification
If you believe that material you posted on our Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our copyright agent containing the following:
- Physical or Electronic Signature: Your physical or electronic signature.
- Identification of Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
- Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Contact Information: Your name, address, and telephone number.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which VibeKeys may be found, and that you will accept service of process from the person who provided notification under DMCA 512(c)(1)(C) or an agent of such person.
If we receive a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. The original complaining party will then have 10 business days to notify us that they have filed a legal action seeking to restrain you from engaging in infringing activity. If we do not receive such notification, we may restore the material.
5. Repeat Infringers
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Image Use Policy
VibeKeys features product images primarily for editorial and informational purposes. We strive to:
- Use product images that are publicly available from retailers and manufacturers
- Link to original product pages where images originate
- Credit sources when required
- Remove images promptly upon valid request
If you are a copyright holder and believe an image on our Site infringes your rights, please follow the DMCA notification procedure above.
7. Trademark Notice
All trademarks, service marks, trade names, and logos displayed on our Site are the property of their respective owners. References to any products, services, or other information by name, trademark, manufacturer, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation by VibeKeys.
8. Fair Use Notice
VibeKeys may contain copyrighted material that has not always been specifically authorized by the copyright owner. We believe this constitutes "fair use" of any such copyrighted material as provided for in section 107 of the US Copyright Law.
If you wish to use copyrighted material from our Site for purposes of your own that go beyond fair use, you must obtain permission from the copyright owner.
9. False Claims Warning
Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. If you are unsure whether the material you are reporting is infringing, you may wish to contact an attorney before filing a DMCA notice.
